Terms & Conditions

These Terms & Conditions govern your use of this website and your engagement with bencharod for intellectual property law services in Thailand. Please read them carefully. By using this website or instructing us on a matter, you accept these terms as they stand.

1. Definitions

In these Terms, the following words carry these meanings:

  • "bencharod" / "We" / "Us" — the legal practice operating under the name bencharod at 198 Charoen Krung Road, Bang Rak, Bangkok 10500, Thailand.
  • "Client" / "You" — any individual or entity that engages our services or uses this website.
  • "Services" — trademark filing and prosecution, copyright advisory and recordation, and IP watch and brand monitoring as described on this site.
  • "Agreement" — these Terms together with any engagement letter or service order.
  • "Content" — all text, images, and materials published on this website.
  • "DIP" — Thailand's Department of Intellectual Property.

2. Acceptance of Terms

By accessing this website or instructing us to act on your behalf, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of a company or other entity, you confirm that you have authority to bind that entity.

Use of this website constitutes acceptance of these Terms. If you do not agree, please discontinue use.

3. Service Description

bencharod provides intellectual property law services in Thailand, with a focus on:

  • Trademark Filing & Prosecution — preparation and filing with the DIP, office action responses, renewals (฿24,500)
  • Copyright Advisory & Recordation — guidance and voluntary recordation under the Thai Copyright Act (฿8,200)
  • IP Watch & Brand Monitoring Setup — quarterly monitoring summaries for relevant trademark classes (฿4,950)

Services are available primarily within Thailand and the ASEAN region. Geographic restrictions may apply to certain cross-border matters; we will advise you at the outset if so.

4. User Responsibilities

When using this website and engaging our services, you agree to:

  • Provide accurate, complete, and current information in all communications and forms
  • Notify us promptly of any changes to information you have provided
  • Refrain from submitting false, misleading, or fraudulent information
  • Use this website only for lawful purposes and in a manner that does not infringe any rights
  • Not attempt to gain unauthorised access to any part of our systems or data

We reserve the right to decline or suspend services where we reasonably believe any of the above have been breached.

5. Intellectual Property

All content on this website — including text, layout, design, and graphics — belongs to bencharod or its licensors and is protected by Thai and international intellectual property law. You may not reproduce, adapt, or distribute any content without our written consent.

Work product we prepare for you in the course of an engagement (such as drafted specifications or advisory notes) becomes your property upon full payment. We retain the right to reference the general nature of matters handled for the purpose of our own professional records.

6. Payment Terms

  • All fees are quoted and payable in Thai Baht (฿) unless otherwise agreed in writing
  • Invoices are issued at the commencement of each engagement, with payment due within 14 days
  • Government filing fees, official fees, and disbursements are additional to our service fees and will be itemised separately
  • Late payment may result in a pause in services until the outstanding amount is settled

Refunds are considered on a case-by-case basis prior to the commencement of substantive work. Once documents have been filed or substantive advice delivered, fees are generally not refundable.

7. Service Delivery

We aim to keep you informed at each stage of your matter. Timelines for IP procedures are largely determined by the DIP and other official bodies and are outside our direct control. We will communicate any delays or developments we become aware of.

Any changes to the agreed scope of a matter — such as additional classes, jurisdictions, or responding to unexpected office actions — may be subject to separate fee arrangements, which we will discuss with you in advance.

8. Disclaimers

Content on this website is for general informational purposes only and does not constitute legal advice. No attorney-client relationship is formed through use of this website alone.

We make no representations that filings will result in registration. Outcomes depend on the DIP's assessment, prior art, and other factors outside our control.

The site is provided on an "as available" basis. We do not accept responsibility for any interruption or inaccuracy arising from technical matters beyond our control.

9. Limitation of Liability

To the extent permitted by Thai law, our total liability to you arising from any single engagement shall not exceed the fees paid by you in respect of that engagement during the 12 months preceding the claim.

We are not liable for any indirect, consequential, or incidental loss — including loss of business, revenue, or goodwill — even if we had been advised of the possibility of such loss. Nothing in these Terms limits liability for fraud or for death or personal injury caused by our negligence.

10. Indemnification

You agree to indemnify and hold harmless bencharod, its staff, and advisors from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your use of the website in an unlawful manner, or any false or inaccurate information you have provided to us.

11. Termination

Either party may terminate an engagement by giving written notice. You remain liable for fees in respect of work already carried out. Where we have filed documents on your behalf, you should promptly advise us of your wishes regarding continuation.

Provisions relating to intellectual property ownership, payment, limitation of liability, and dispute resolution survive termination.

12. Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute, we encourage the parties to seek an amicable resolution in the first instance by contacting us directly.

If informal resolution is not achieved within 30 days, disputes shall be referred to the courts of Bangkok, Thailand, which shall have exclusive jurisdiction.

13. General Provisions

  • Entire agreement: These Terms, together with any engagement letter, constitute the entire agreement between us.
  • Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
  • Waiver: Failure to enforce any provision does not constitute a waiver of our rights.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
  • Notices: Written notices may be sent by email to the addresses we exchange during our engagement.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the effective date above. Continued use of our website or services after such changes indicates your acceptance. If changes affect an ongoing engagement, we will inform you directly.
