Why bencharod

Considered Counsel at Each Step

DIP-Experienced Practice

We work with Thailand's Department of Intellectual Property regularly and are familiar with current examination practices and filing expectations.

Precise Class Guidance

Selecting the wrong classes is a common and costly oversight. We spend time understanding your business before recommending any filing strategy.

Clear Written Summaries

After each stage of work, you receive a plain-language summary of what was filed, what is pending, and what the next steps are.

ASEAN Market Awareness

For clients expanding regionally, we can discuss parallel filing options across ASEAN member states and the ARIPO pathway where relevant.

Proactive Watch Coverage

Trademark registration is not the end of the process. Our monitoring service gives you early notice of potentially conflicting filings before they become harder to address.

Restrained, Honest Advice

We will tell you when a filing is unlikely to succeed or when monitoring is not yet necessary. Our advice is calibrated to your actual situation, not a standard service list.

Begin the Process

A Conversation Before a Filing

Most engagements begin with a short consultation — an opportunity to discuss your brand, your business context, and whether the service makes sense at this stage. There is no obligation to proceed.

Common Questions

Frequently Asked

How long does trademark registration in Thailand typically take?
The Department of Intellectual Property generally takes 18 to 24 months to examine an application and issue a registration certificate, assuming no objections or oppositions arise. If an office action is issued or a third party files an opposition, the timeline extends accordingly. We keep you informed at each stage so there are no unexpected surprises.
Do I need to register my copyright in Thailand, or is it automatic?
Under Thai copyright law, protection attaches automatically at the moment of creation — no registration is required. However, voluntary recordation with the DIP creates a dated record that can be useful if you ever need to demonstrate ownership in a dispute. We advise on whether recordation is worth pursuing based on your specific work and how you intend to use it.
Which trademark classes should I file in?
This depends on what your business actually does and how you use the mark. Thailand follows the Nice Classification system. Filing in too few classes can leave gaps in your protection; filing in classes you do not genuinely use can create vulnerabilities at renewal. We discuss this carefully before recommending any specific filing strategy.
What does the IP Watch service actually deliver?
Each quarter, we provide a written summary of new trademark applications filed in the classes we monitor. The summary notes any applications that share visual or conceptual similarity with your marks, along with a brief explanation of the possible concern and the options available to you. We do not send alerts for every new filing — only those that merit a second look.
Can bencharod help with trademark matters in other ASEAN countries?
Our practice is focused on Thailand. For regional matters, we can provide orientation on the different national systems and, where appropriate, refer you to trusted practitioners in specific jurisdictions. We prefer to be clear about the limits of our practice rather than overstate our reach.
What information do I need to bring to a first consultation?
A brief description of your business, the mark or work you want to protect, and a general sense of the markets you operate or plan to enter is sufficient for an initial conversation. If you have existing registrations, a list of them is helpful. We do not expect you to arrive with a prepared brief — that is our role.
