Where the Practice Began
bencharod was established in Bangkok's Bang Rak district by a small group of practitioners who had spent years working within larger commercial law firms. The pattern they noticed, consistently, was that intellectual property matters — particularly for smaller brand owners, independent studios, and software startups — were often handled as a secondary concern, squeezed between higher-value transactional work.
The firm takes its name from the five-color enamel pottery that has been made in Thailand for centuries. bencharod ware is produced slowly, with distinct colours applied in sequence, each layer dependent on the last. The finished piece is a composition of patient decisions. That discipline resonated with the founders as a metaphor for IP practice: each filing, each class selection, each response to an office action is a decision that shapes what comes after.
Since opening, the practice has focused on three areas — trademark prosecution, copyright advisory, and brand monitoring — rather than broadening into a general IP offering. The decision to remain narrow was deliberate. Depth matters more than range in this kind of work.
The practice operates from offices on Charoen Krung Road, a street that has been a centre of Bangkok's trading and commercial life for well over a century. The address, and the history it carries, suits the work.

Intellectual Property Counsel in Bangkok
Thailand's Department of Intellectual Property operates a national trademark registry that covers goods and services across all 45 Nice Classification classes. For a brand operating in Thailand — whether in retail, technology, hospitality, or the creative industries — registration in the relevant classes is the clearest way to establish a recorded claim to a mark.
The process is not administratively complex, but it requires attention at several points: class selection at the outset, specification wording that accurately reflects commercial use, a search to identify conflicts before they become expensive problems, and a response strategy if the examiner raises objections. Each of those steps carries consequences for what comes after, which is why bencharod handles them carefully and explains each decision as it is made.
For copyright, Thai law provides automatic protection from the moment of creation. The question for most clients is not whether protection exists, but how to document ownership clearly enough that it can be relied upon if a dispute arises. Voluntary DIP recordation, well-maintained creation records, and clear licensing documentation each contribute to a stronger position. We discuss which of these is appropriate based on what you have created and how you intend to use it.
