Case Study 01 — Trademark Prosecution

A Refused Application Rerouted to Registration

Challenge

A Bangkok-based beverage brand had filed a trademark application through a general administrative service. The DIP issued a refusal citing a registered mark in the same class with a similar phonetic profile. The client came to us after receiving the refusal notice, with 60 days remaining to respond.

Approach

We reviewed the cited mark and the client's mark side by side, assessed the strength of the objection, and identified three grounds on which a response could be based: distinctiveness of the visual element, differences in the specification, and evidence of concurrent use without confusion in the market. A response was drafted and submitted within three weeks of instruction.

Outcome

The DIP accepted the response and allowed the application to proceed. The mark was published without further objection and registered 14 months after the response was filed. The client has since instructed us to set up a watch service to protect the mark going forward.

Case Study 02 — IP Watch

An Opposition Filed Before a Conflicting Mark Was Registered

Challenge

A client in the wellness sector had registered their brand mark in Thailand two years earlier. They had no monitoring in place. A quarterly report from our watch service flagged a new filing in the same class, with a device element visually similar to our client's registered mark.

Approach

We notified the client within five days of the quarterly report's preparation. We explained the opposition window, the strength of the visual similarity argument, and the evidence that would support an opposition. The client authorised us to file an opposition with four weeks remaining in the window.

Outcome

The applicant did not contest the opposition and allowed their application to lapse. The client retained an uncontested registered mark in the relevant class. The cost of the watch service and opposition handling was substantially lower than what a post-registration challenge would have required.

Case Study 03 — Copyright Advisory

Preparing an Audiovisual Library for Regional Licensing

Challenge

An independent production studio was preparing to license a library of 40 short documentary films to a regional streaming platform. The contract offered by the platform was broad and the studio was uncertain about what rights they were handing over and whether their ownership of the underlying works was documented clearly enough to enforce it.

Approach

We reviewed a sample of the works and the proposed licensing contract, identified three areas where the studio's ownership documentation was weaker than it should be, and recommended specific amendments to the contract that would limit the scope of the grant without making the deal unattractive to the licensee. We also advised on which titles would benefit from DIP recordation given their commercial value.

Outcome

The platform accepted the amended contract without significant negotiation. The studio entered the licensing arrangement with a clearer record of ownership for 12 of the 40 titles and improved documentation practices for all future productions.
